Preparing For Class Action Wage and Hour Claims
An increasing number of class action wage and hour lawsuits are being filed targeting districts and county offices of education. The lawsuits typically allege violations of California and federal wage-and-hour laws. Frequently, such claims are not within the parameters of memoranda of coverage issued by insurance companies or joint powers authorities, meaning employers are on the hook for costs of defense and potential multi-million-dollar damages. Effective record keeping along with compliant policies and practices are the key to defending wage-and-hour claims; however, most districts and county offices of education have geographically diverse work locations which impair the ability to oversee compliance with the highly technical laws and record keeping requirements. Longstanding, but often outdated, practices along with a dispersed workforce combine to put many districts and county offices of education in a vulnerable position.
