Alternatives to Expulsion/Other Means of Correction

The Education Code seeks to ensure that school discipline policies and practices are safe, positive, supportive, and equitable.  In recent years, concern has grown about the impact of suspensions and expulsions on minority students and students of color.  Data shows the students of color are disproportionately suspended and expelled from school.  The public policy of the state and the purpose of Education Code section 48900.5 is to provide effective interventions for students to help students change their behavior and avoid exclusion from school.  This session will discuss the various alternatives to suspension set forth in the Education Code.

Presenting/Prosecuting the Expulsion Case

This session will touch upon the variety of steps to be taken in preparing an expulsion case for presentation to the administrative hearing panel, including investigation of the alleged misconduct, preparation of the suspension and expulsion paperwork, identifying and preparing witnesses for testimony, anticipating defenses and legal arguments, and marking and presenting evidence at the hearing.

Serving on/Advising the Administrative Hearing Panel

This session highlights the “must do activities” of the Student Services Director tasked with arranging and presiding over the expulsion hearing panel.  This session also covers the panel’s special role and required procedure to consider student/staff witness statements of those witnesses afraid to reveal their identity or testify in person due to fear of psychological and/or physical harm.  Attendees will be taught the practical differences between hearsay evidence and direct evidence in non-legal terms.  Attendees will leave this session with the essential information they need to serve as fair minded and effective panel members.

April 23, 2021 | 8:00-9:00 a.m.
Appearing before the Board and/or COE

The Education Code authorizes parents to appeal the expulsion of their children to the district’s governing board of education.  Further, the law authorizes an additional and final appeal of school board’s expulsion order to the county board of education.  This session will focus on the various issues that arise during appeal hearings to a school district’s governing board of education and a county board of education.  Members of this panel have extensive experience with school boards and county boards and the decision making processes utilized by both bodies.
