Governor Brown recently signed two pieces of legislation that completely change the confidential status of peace officer personnel files.
SB1421 requires the release of certain peace officer personnel files pursuant to a California Public Records Act (“CPRA”) request. This includes all records relating to officer involved shootings, use of force that results in death or great bodily injury, and sustained findings of sexual assault and dishonesty.
AB748 requires the release of video and audio recordings of critical incidents pursuant to a CPRA request.
