Over recent years, there have been a number of changes to laws affecting employers that contract with CalPERS and CalSTRS, including public education employers. These changes increase employer exposure for damages for misreporting to CalPERS/CalSTRS and place additional burdens on agencies undergoing a CalSTRS audit. Senate Bill 278 changed the method in which CalPERS collects overpayments made to retirees and shifts liability to employers whose misreporting caused the overpayments. Assembly Bill 1667 adopts similar overpayment provisions for CalSTRS contracting agencies, and also implements changes to CalSTRS audits, including requiring the involvement of the exclusive representative of employees impacted by the audit. This presentation will discuss the scope of Senate Bill 278 and Assembly Bill 1667, and how public education employers can take proactive steps to mitigate liability for reporting errors.
