On October 3, 2022, the Supreme Court denied certiorari in S.W. v. Capistrano Unified School District. This means that the 9th Circuit’s previous December 30, 2021 ruling, in Capistrano USD v. S.W. and C.W. on behalf of their minor child, B.W. is affirmed. In this presentation, Alefia Mithaiwala, the attorney who litigated the underlying due process case of this important decision, will explain the facts of the case, the arguments at the 9th Circuit, and the impact of the Supreme Court’s denial of certiorari, with respect to school district obligations for privately placed students with disabilities.
Ms. Mithaiwala will also highlight important similarities and differences in school district obligations to privately placed students under IDEA and Section 504.
