Many public employees have taken to social media as an outlet to discuss their thoughts and opinions, including on politics, religion, and even their employers.  Increasingly public employers want to use the employee’s social media or speech against them for disciplinary or other purposes.  However, public sector employees have First Amendment protection.  The employer must be careful before infringing on an employee’s free speech rights.
