Ash Bhargava has extensive experience litigating in state and federal district courts across California as well as before administrative agencies such as the Department of Fair Employment and Housing, U.S. Equal Employment Opportunity Commission, Department of Industrial Relations, Labor and Workforce Development Agency, and Workers’ Compensation Appeals Board.
He has aggressively litigated and resolved disputes involving employee complaints of discrimination (age, sex, disability, religion, etc.), sexual harassment, hostile work environment, retaliation, misclassification, wrongful termination, negligent hiring, intentional infliction of emotional distress, joint employer liability, respondeat superior, assault and battery, whistleblowing, breach of contract, complex multi-party wage and hour class and PAGA representative actions involving meal and rest breaks, off-the-clock, wage statements, payroll practices, overtime, and rounding.
He is also an experienced legal adviser. Rather than acting defensively, he employs forwarding thinking offensive-like tactics to ensure that his clients stave off lawsuits and comply with all aspects of employment law including employment agreements, hiring practices, personnel policies and procedures, meal and rest periods, overtime, regular rate, wage and hour attestations, timekeeping strategies, exempt classifications, independent contractor relationships, staffing agreements, indemnification agreements, arbitration agreements, terminations, leaves of absence, reasonable accommodations, and good faith interactive processes.
He represents clients across many industries including but not limited to: hospitality, trucking, temporary labor/staffing, PEO, fitness, healthcare, aerospace, construction, pharmaceutical, car dealerships, air transport, food production, manufacturing, bars and restaurants, social media, cable and satellite distribution, assisted living, shipping, entertainment services, electronics, engineering, public works, insurance, civil servants, non-profit, finance, newspaper and magazine, residential care, publishing and printing, real estate, retail sales, textiles, security, and transportation.
Mr. Bhargava graduated magna cum laude from the University of California Los Angeles with a degree in political science and a concentration in international relations. He received his Juris Doctor from the University of Oklahoma College of Law. Before joining AALRR, Mr. Bhargava was a judicial extern for the Honorable Timothy D. Degiusti at the District Court for the Western District of Oklahoma and served as a law clerk at the United States Attorney’s Office in the Western District.
