Overtime Miscalculation Lawsuits Premised on the Flores Ruling—and How to Mitigate Them 

The Ninth Circuit Court of Appeals’ 2016 decision, Flores v. City of San Gabriel, has dramatically affected California employers that offer cash payments in lieu of receiving benefits. In Flores, the court held that cash in lieu of benefits payments must be included in calculating employees’ regular rate of pay for purposes of overtime. The court’s expansive reading of the FLSA has led to a spike in overtime rates. Further, the Flores court’s generous award—double damages over a three-year period, plus interest and attorney’s fees—has triggered a landslide of class action suits.

This briefing will explore the impact of the Flores ruling, questions it left unanswered, and ways to avoid overtime by providing alternatives to cash in lieu payments to employees.
