AWI Webinar: A Banner Year for the NLRB: How Recent NLRB Decisions Impact Workplace Investigations
In recent years the National Labor Relations Board (NLRB) has actively sought to expand rights of employees in the workplace. While typically one thinks of the NLRB as an agency dealing with issues of union representation, the NLRB’s expansive approach to employee rights broadly impacts the investigation process in all workplaces regardless of union representation.
The NLRB’s recent ruling in Banner imposes limits on when employers can demand confidentiality of employees during workplace investigations. The NLRB’s Fresh & Easy ruling compounds the confidentiality dilemma by empowering employees to recruit witnesses for their side during a workplace investigation. The ruling in Piedmont Gardens opens the door for unions to obtain confidential witness statements employers obtained from employees.
Attorney Thomas Lenz and workplace investigator Michael Robbins will discuss recent NLRB rulings, how they impact the work of investigators, and tips for workplace investigators. Both are former NLRB agents and can share perspectives from their experience inside the agency and from years of experience dealing with workplace issues.
