Effectively Managing Leaves of Absence

Session One A

The intricacies of California employment law complicate the challenges employers face in managing and coordinating leaves of absence. Failure to comply with state and federal leave laws can create significant liability.  This session will provide an overview of requirements pertaining to leaves, including a review of the various types of leaves and the interplay between them.  The session will also offer guidance as to required notifications, record keeping, and tips to avoid mismanagement of leaves.

Today’s employees are more knowledgeable than ever with respect to both their rights and employer obligations in the workplace. Employees do not hesitate to express themselves on an individual and collective basis.  This session will feature a thoughtful exchange concerning employee rights of speech and expression (both within and outside the workplace). This session will also include a discussion with AALRR founding partner, Steven Atkinson, regarding the NLRB’s increased focus on non-union employers with respect to employee speech and expression.

Unraveling Reasonable Accommodation in the Workplace

Session Two A

One of the most frequent claims made against California employers is the alleged failure to provide reasonable accommodation to employees and applicants with a disability.  This session will explore state and federal requirements and offer practical strategies to identify when an employer’s obligation to engage in the interactive process is triggered, when reasonable accommodation is required, and what constitutes a “reasonable” accommodation.  This session will also provide practical guidance for addressing pandemic-related accommodation issues.

A Guide to Wage and Hour Compliance in 2022

California leads the nation in claims related to wage payment and hours of work.  Employers found to be in violation can incur considerable civil damages, monetary penalties, attorney’s fees, and other expenses.   This session will provide a comprehensive overview of recent court cases and laws affecting minimum wage and overtime requirements, discretionary bonuses and incentive pay, proper calculation of meal and rest period premiums and sick pay, employee and independent contractor classification issues, remote work challenges, and pay issues particular to the pandemic.

Session Three A

Effective workplace investigations are crucial to addressing many of the concerns faced by employers today.  This session will explore important aspects of workplace investigations, including understanding when an investigation is required, addressing privacy concerns, gathering evidence, utilizing proper interviewing techniques, assessing witness credibility, reaching a conclusion that is supported by the evidence, and preparing an appropriate investigative report.  This session will also include a discussion of challenges associated with conducting workplace investigations remotely.

Two important components for mitigating employer risk are consistent discipline and sound documentation.   This session will provide insights into developing and executing effective disciplinary processes, drafting sound documentation that supports the discipline, and appropriate communication of the imposed discipline to the employee.  This information can be utilized by managers and supervisors at all levels of the organization.
