Title IX Protections of Transgender Students: The Current State of the Law and a Plan for Compliance

Protecting the civil rights of transgender students is an important issue receiving increased national attention. The U.S. Departments of Justice and Education recently released guidance clarifying that Title IX’s prohibition of sex discrimination includes a prohibition of discrimination based on a student’s gender identity or transgender status. The Departments’ clarification of federal law is aligned with recent changes in state law that require school districts to allow students to participate in athletics and use facilities consistent with their gender identity, irrespective of the gender listed on their records. However, school districts and colleges throughout the country and California are still grappling with difficult questions on how best to serve the interests of all students while ensuring that the civil rights of transgender students are protected. This briefing will provide an analysis of the legal requirements governing educational institutions’ handling of issues involving transgender students, including an overview of the current state of the law as well as analysis of recent and pending court cases addressing the Title IX protections of transgender students.
