Paul G. Szumiak

Practice Areas

Paul Szumiak is Of Counsel in the Cerritos office.  In his 30-year career, he has successfully litigated a wide array of civil matters: professional negligence, trade secrets and intellectual property, insurance and business fraud, personal injury and wrongful death, and product defect.  Currently, he focuses his practice on the defense of wage and hour class actions and on other employment law matters such as sexual and racial harassment, discrimination, and wrongful termination.  Mr. Szumiak has extensive experience in mediations, arbitrations, and bench and jury trials.

Mr. Szumiak earned his bachelor of arts degree with honors in economics from Michigan State University.  He earned his Juris Doctor from Southwestern University School of Law (Top 15% in Class). 

Representative Matters
Mr. Szumiak has successfully litigated numerous actions in a wide range of industries: trucking and transportation, security, entertainment, restaurant and hospitality, personnel services, and healthcare.  Mr. Szumiak recently won an important California Supreme Court decision, Roy Allan Slurry Seal, Inc., et al. v. American Asphalt South, Inc., 2017 WL 631765 (Ca., Feb. 16, 2017). In a case of first impression, the court unanimously agreed that the claim against Mr. Szumiak’s client for intentional interference with prospective economic advantage should be dismissed.

In his wage and hour practice, Mr. Szumiak recently defeated class certification in a case brought on behalf of persons employed in the modeling business.  The decision was upheld on appeal. He also recently defended a large municipal entity in the Court of Appeal and obtained a dismissal with prejudice in a significant wage/hour class action.  In addition, he successfully represented employers in matters filed against former employees for embezzlement and theft of trade secrets.  In one case, Mr. Szumiak collected $400,000 from former employees who misappropriated their employer’s assets.
